The Chinese Bar Exam and the ?Turn Against Law?

In recent years, Chinese central authorities have turned against a range of legal reforms that they had pursued in the late 20^th century ? a professional judiciary, resolving administrative and civil disputes through court trials, and so on. (For more on this, see here.)

These reflect deeper shifts in political winds blowing from the top of the system.? Starting in 2006, Party authorities launched ?Socialist Rule of Law? political campaigns re-emphasizing Party supremacy and warning against the infiltration of ?Western? rule-of-law concepts.? These new ideological efforts have become a regular feature within Chinese courts and other legal institutions, reflected in new materials for judges to review in internal political study sessions.

Changed state attitudes have shown up in another venue as well ? namely, the national judicial examination (sifa kaoshi).?

The national judicial examination is required for all new lawyers, judges, or procuratorate officials.? When implemented in 2002, the test was widely regarded as a step forward in terms of creating unified standards for Chinese legal professionals and in increasing their educational qualifications (since a university degree is required to sit for the exam).? Early exams were relatively apolitical, broadly testing applicants on Chinese law, including civil, commercial, and criminal law, legal history, and professional responsibility. (1) However, starting in 2007, Chinese authorities amended the content of the exam to include Socialist Rule Of Law as a major field on which applicants would be tested.

What differences has this introduced? Well, compare the 2003 and 2010 exams. The general format has remained unchanged (three sets of multiple choice questions followed by essays).? But unlike the 2003 test, the political content is quite clear in the 2010 version (as it is in the 2011 exam as well).? The first five multiple-choice questions are very direct. (Did you remember the need to firmly uphold the people?s democratic dictatorship?).? Further, the first essay question requires the applicant to discuss their understanding of socialist rule?of-law, in light of a 2009 speech by the head of the Party?s Political-Legal Committee on the Party?s need to maintain social control and stability.?

Of course, this needs to be placed in perspective.? Less than 5% of the 2010 test is explicitly political in nature.? Just as in 2003, the 2010 exam primarily revolves around whether students remember principles drawn from contract law or criminal procedure or international law.? Moreover, it is unlikely that the exam itself has any lasting impact on most students.? Just as with their counterparts abroad, most Chinese law students simply memorize and regurgitate whatever content (whether Party doctrine or the Rule Against Perpetuities) is required to pass the exam.

On the other hand, there is a difference.? This is not the same exam as in the early 2000s. The new political material sends a visible signal, both by its inclusion and by its placement in the front of each section, as to new official priorities.

(1) This is not to say that the 2003 exam was completely free of political content.? Two or three of the multiple-choice questions in the first section might be construed as loaded.? Try the following one.

The answer? A, B, and D are not required under law.? Only C is. (The first two statements are from the constitution and general principles of civil law, respectively, while D is taken from the Party charter ? none of which is legally binding.)?

NASA's Kepler discovers multiple planets orbiting a pair of stars

ScienceDaily (Aug. 28, 2012) ? Coming less than a year after the announcement of the first circumbinary planet, Kepler-16b, NASA's Kepler mission has discovered multiple transiting planets orbiting two suns for the first time. This system, known as a circumbinary planetary system, is 4,900 light-years from Earth in the constellation Cygnus.

This discovery proves that more than one planet can form and persist in the stressful realm of a binary star and demonstrates the diversity of planetary systems in our galaxy.

Astronomers detected two planets in the Kepler-47 system, a pair of orbiting stars that eclipse each other every 7.5 days from our vantage point on Earth. One star is similar to the sun in size, but only 84 percent as bright. The second star is diminutive, measuring only one-third the size of the sun and less than 1 percent as bright.

"In contrast to a single planet orbiting a single star, the planet in a circumbinary system must transit a 'moving target.' As a consequence, time intervals between the transits and their durations can vary substantially, sometimes short, other times long," said Jerome Orosz, associate professor of astronomy at San Diego State University and lead author of the paper. "The intervals were the telltale sign these planets are in circumbinary orbits."

The inner planet, Kepler-47b, orbits the pair of stars in less than 50 days. While it cannot be directly viewed, it is thought to be a sweltering world, where the destruction of methane in its super-heated atmosphere might lead to a thick haze that could blanket the planet. At three times the radius of Earth, Kepler-47b is the smallest known transiting circumbinary planet.

The outer planet, Kepler-47c, orbits its host pair every 303 days, placing it in the so-called "habitable zone," the region in a planetary system where liquid water might exist on the surface of a planet. While not a world hospitable for life, Kepler-47c is thought to be a gaseous giant slightly larger than Neptune, where an atmosphere of thick bright water-vapor clouds might exist.

"Unlike our sun, many stars are part of multiple-star systems where two or more stars orbit one another. The question always has been -- do they have planets and planetary systems? This Kepler discovery proves that they do," said William Borucki, Kepler mission principal investigator at NASA's Ames Research Center in Moffett Field, Calif. "In our search for habitable planets, we have found more opportunities for life to exist."

To search for transiting planets, the research team used data from the Kepler space telescope, which measures dips in the brightness of more than 150,000 stars. Additional ground-based spectroscopic observations using telescopes at the McDonald Observatory at the University of Texas at Austin helped characterize the stellar properties. The findings are published in the journal Science.

"The presence of a full-fledged circumbinary planetary system orbiting Kepler-47 is an amazing discovery," said Greg Laughlin, professor of Astrophysics and Planetary Science at the University of California in Santa Cruz. "These planets are very difficult to form using the currently accepted paradigm, and I believe that theorists, myself included, will be going back to the drawing board to try to improve our understanding of how planets are assembled in dusty circumbinary disks."

Ames manages Kepler's ground system development, mission operations and science data analysis. NASA's Jet Propulsion Laboratory in Pasadena, Calif., managed the Kepler mission development.

Ball Aerospace & Technologies Corp. in Boulder, Colo., developed the Kepler flight system and supports mission operations with the Laboratory for Atmospheric and Space Physics at the University of Colorado in Boulder.

The Space Telescope Science Institute in Baltimore archives, hosts and distributes Kepler science data. Kepler is NASA's tenth Discovery Mission and funded by NASA's Science Mission Directorate at the agency's headquarters in Washington.

The Engadget Show 35: EVs in Portland, hacked bicycles and a Tesla Model S test drive

With a transportation themed episode, it only seemed natural to take the Engadget Show out of our traditional digs -- it was also a great excuse to visit one of our favorite cities in the world: Portland, Oregon. We drove Mitsubishi's i-MiEV EV around the Northwestern green mecca, stopping at some great PDX spots along the way, including the amazing Ground Kontrol arcade, Hand-Eye Supply and the hackerspace, Brain Silo. We also took the time to speak to some PDX residents, including Core77 co-founder Eric Ludlum and some local modders showing off their homebrew projects.

Also, Brian travels out to Boston to ride along with a gang of bike hackers, Myriam takes the Tesla Model S for a spin around the streets of San Francisco and Michael does his best not to fall off the DTV Shredder in the California desert. Droopys Alex was a massive eyecatcher on debut, and has very nice prospects. Luck was not only thing that prevented him from starting off his journey on a winning note, as he missed the gold medal only by a head?s distance. After a fantastic outing, his confidence would be at a high, but the pressure is bigger this time.

Rince Cosmo should be suited by this draw. The brindle bitch is not in good rhythm though. Tewmax Leejay was not impressive on recent trial outing. Droopys Pride clearly has speed, but needs to stay out of trouble. Jolly Girl clocked a smart sprint time at Kinsley, but this is far from easy.

Droopys Alex is the only big threat to Kowloon Conner. An exciting battle between the pair is on the cards. Good luck to all the hounds.

Logitech teases new Ultimate Ears lineup, says it's bringing 'power to the music' on August 29th

Having most recently introduced products like its water-friendly K310 washable keyboard and that TV Cam HD, Logitech's now apparently prepping a fresh Ultimate Ears portfolio for all sound lovers out there. Via its UE page on Zuck's social network, the company's teasing a plethora of products with some rather suppressive shots that don't quite tell us what's on the other end, though we can slightly see new headphones and speakers will be the focus of the main 'Power to the Music' event in a couple of days -- or August 29th, to be exact. Hippo stuck in SAfrica swimming pool

JOHANNESBURG (AP) ? A hefty hippo chased away from his herd at a South African game reserve has found a refreshing place to relax: the lodge's swimming pool. Now it's stuck there.

The young hippopotamus plopped into the pool on Tuesday at the Monate Conservation Lodge north of Johannesburg. The pool is big enough for the hippo to swim but it's eight feet deep with no steps and "there's no way he can come out," lodge manager Ruby Ferreira told The Associated Press on Thursday.

A game capture team will sedate the hippo and lift it out of the pool with a crane, said MuIsabel Wentzel of South Africa's National Society for the Prevention of Cruelty to Animals. Much of the water has already been drained to make the extraction easier. A veterinarian will be present during operation hippo extraction on Friday.

Wentzel said the 4-year-old hippo's mother gave birth recently, and more dominant males forced him from the herd.

The staff has been feeding the hippo. Ferreira said it's been noticeably relaxed with no other hippos fighting it for dominance, though the water in the pool has been getting mucky with hippo poop. The pool will be entirely drained before the hippo is lifted out.

Because the hippo was chased away by his herd, it will be moved to another animal sanctuary, Ferreira said.

Researchers develop DNA sequencing tests for hereditary diseases

ScienceDaily (Aug. 16, 2012) ? Scientists at the University of Medicine and Dentistry of New Jersey-New Jersey Medical School (UMDNJ-NJMS) have developed new DNA sequencing tests that hold significant promise for decreasing costs associated with diagnosing cancer and hereditary diseases, including cystic fibrosis.

Officials at the New Jersey Department of Health approved the use of the new Cystic Fibrosis (CF) Carrier and Diagnosis Test, which was created at the Institute for Genomic Medicine at UMDNJ-NJMS. Using a semiconductor mechanism that was developed by San Francisco-based Ion Torrent, the microchip tests the entire gene for mutations. IGM now offers this certified Clinical Diagnostic Laboratory service for hospitals as well as obstetrics and gynecology practices throughout the Garden State.

According to the Cystic Fibrosis Foundation web site, "More than 10 million Americans are symptomless carriers of the defective CF gene." This chronic disease impacts the lungs and the digestive system. It occurs when a child inherits one defective CF gene from each parent. Statistics show New Jersey averages 125,000 births of children who are diagnosed with cystic fibrosis annually.

"We believe the adaptation of this new sequencing technology will drastically improve our ability to analyze genetic disorders," said Marvin N. Schwalb, PhD, director of the Institute for Genomic Medicine. "Traditional CF sequencing testing costs thousands of dollars making the test unavailable for carrier screening. This new test costs less than $200. Most importantly, the genetic carrier test we developed improves the diagnosis rate to 98 percent. While the test provides significant improvement for all populations, the improved rate is particularly valuable for minorities because current carrier screening methods only detects approximately 65% of mutations in these populations."

The new technology provides many advances including the ability to test as many as 96 samples on a single platform and the fact that the equipment cost 1/10 as much as the previous technology.

IGM has developed another test, which was also approved by the NJHSS, for mitochondrial DNA. Mutations in mitochondria cause a wide variety of diseases, such eye and neuromuscular system disorders and possible cancer.

Schwalb, a professor of Pediatrics, Microbiology and Molecular Genetics at NJMS, said, "We are proud of the fact that the IGM is a world leader in the advancement of genetic diagnosis. DNA sequencing will keep us very busy for a while. In the state of New Jersey, there is nothing that compares to this advancement and this is just the beginning."

Working through a comprehensive list of considerations can help make the task easier and will identify resources and decisions about elder care and your property.

Durable Power of Attorney

Durable power of attorney is a legal document naming someone to act on your behalf if you are unable to make decisions about your own care, either mentally or physically. This person has legal permission to pay your bills, direct your medical care and make other financial decisions for you.

There are two types of durable power of attorney:

- Medical

Durable power of attorney for health care allows a selected person to make medical choices on your behalf if you are not able to do so. This person will be the point of contact for your doctors and other medical personnel.

- Financial

Durable power of attorney for finances is the person who has authority to make financial choices and transactions on your behalf. This may include power over your real estate, social security, investments, tax returns, and paying your bills.

Note that you do not have to select the same person as your durable attorney for medical care and finances, but you certainly may. However, it is a good idea to create separate documents naming the durable power of attorney for health care, and one for the durable power of attorney for finances. This helps keeps the issues separate and provides a clear directive for your family and others.

Living Will

Also known as an advanced care directive, a living will provides instructions for your care if you are unable to make decisions on your own. Establishing a durable power of attorney for medical decisions is often part of creating an advanced care directive.

In your advanced care directive, you can provide instructions regarding organ donation and your wishes regarding the use of CPR, prolonged use of a respirator, blood cultures and other invasive diagnostic tests, artificial nutrition through a tube or IV and/or blood transfusions. In addition, an advanced care directive may include a Do Not Resuscitate Order (DNR) if you stop breathing or your heart stops beating. A DNR states that you do not wish to have measures taken to restore your heartbeat or breathing if either or both stop.

Spend the time thinking about how you feel regarding these issues and speak with your family about your wishes and theirs before completing the advanced care directive.

Long Term Care Insurance

Another important factor in elder care is long term care insurance (LTCI), which helps cover the cost of your medical and living expenses not covered by traditional health insurance, Medicaid, or Medicare.

Long term care insurance helps cover the cost of home care, adult daycare, nursing home, assisted living, and other out-of-pocket costs associated with elderly care. Note that some insurance companies require a waiting period before the LTCI policy goes into effect. Check with your insurance company for more information.

Income and Expenses

Another important element in preparing for the costs of care and transitioning of financial control to family members includes writing down important financial information for your family to use as needed.

This information should include the following:

- Monthly income sources

Write down your regular sources of income, such as social security or pensions. Include your account information and policy numbers.

- Monthly expenses

Write down your monthly expenses, such as your mortgage or rent, utility bills, cable, television, phone and any other bills that you are responsible for on a monthly basis. Include your account number and any passwords for online access.

Will

A will identifies the division of your property and assets after your death. Here are some of the basics to consider:

- Property

Clearly identify who is to receive ownership of your property, whether it is a person or an organization. Be aware that property and estate taxes can be complicated, so contact a local lawyer to help you figure out how to pay the state and federal taxes and how to keep your property out of probate court.

- Executor

The executor makes certain that the terms of the will occur according to your wishes.

Trust

A trust is an estate plan for minor children to whom you wish to leave money but want to manage its execution. Several elements will help avoid problems for those working to establish the trust.

- Life insurance trust

An irrevocable life insurance trust will put the proceeds from your life insurance policy back into your estate while protecting the proceeds from federal estate taxes. Speak with your life insurance company about setting up an irrevocable life insurance trust associated with your life insurance policy.

- Protection

Ensure that your money goes to minors as you wish by determining the amount of money that you wish for each minor child to receive each year. You may also determine an age at which the final lump sum will pay out to the child, such as after college graduation or age 25.

In addition, you can ensure that the money goes to funding the education of minor children by specifying the use of the money, such as tuition or school fees.

- Charity

A charitable trust can specify that some or all of your money is to go towards a charity or charities of your choice.

While getting your financial situation and wishes in order can be time consuming, doing so will make life easier for you and your family as your health progresses or in case you are no longer able to make decisions on your own.

In Week One of the 1997 NFL season, Jerry Rice tore his ACL. In Week 16 of the same season, he stunned everyone by returning to the field, less than four months later. But Rice, who suffered a cracked kneecap while catching a touchdown pass in that Week 16 return, now says he regrets rushing back from his torn ACL. And he fears that Vikings running back Adrian Peterson is doing the same.

Rice said today on NFL Live that he believes that second knee injury of 1997 was related to the first one, and that he should have been more cautious about his return from a major knee injury.

?I cracked my patella,? Rice said. ?I feel that I rushed myself back to the football field. And I think that with Adrian Peterson, he?s doing the same thing. Because we are accustomed to being out there with the guys, sweating with the guys, fighting on the football field. And if you?re not able to do that you just don?t feel connected. And that?s the reason why I rushed back. I hope he doesn?t do the same thing.?

Rice was so desperate to get back to work after tearing his ACL that after surgery, he disobeyed doctors? orders and sawed the cast off his own leg so that he could start working out again. Rice now believes that was foolish.

?I thought I was invincible,? Rice said. ?I felt I did all the work and it was time for me to get back on that football field. But if I had to do it all over again, I would take more time to heal up, then come back.?

Peterson hasn?t rushed back the way Rice did: Peterson, who tore his ACL on December 24, has already rehabbed his knee for more than twice as long as Rice did. But Rice?s cautionary tale is still valuable for the Vikings, who shouldn?t let Peterson go back to full contact until the doctors are certain he?s ready, no matter how badly Peterson himself wants to return to the field.
